GENERAL CONDITIONS OF YACHT RENTAL:

# Clients must have a valid navigation license approved by the Croatian Ministry of the Seas.

# They should handle the boat carefully and responsibly.

# Keep a private logbook and report damages to our company.

# Participation in regattas needs our written consent.

# Follow local laws and regulations.

# Prohibited items transportation is not allowed.

# Leaving the Croatian territorial sea requires our written approval (Permit).

RENTAL PRICE AND PAYMENT:

# Rental Price Inclusion: The rental price covers chartering the boat with standard equipment, a full fuel tank, and boat and crew insurance for the rental period.

# Rental Price Exclusion: The rental price does not include marina costs (except berth in Marina Kaštela), parking fees, berths in other marinas, fuel, skipper, hostess, cook services, crew health insurance, or other optional services, unless specified in the written booking confirmation/contract.

# Confirmation and Acceptance: Once the Client decides to book, they must confirm the booking in written form and receive the booking contract via email. By doing so, the Client accepts our company's General Terms and Conditions.

PAYMENT TYPE:

# Payment Schedule: The client must pay 25% of the charter price to confirm the booking, another 25% by the end of March, and the remaining 50% balance not less than 4 weeks before the charter start date, unless otherwise agreed in the booking contract.

# Advance Payment: Within 7 days from confirmation, the client must make a 25% advance payment of the total charter price.

# Balance Payment: The remaining balance must be settled 4 weeks before the charter starts. The client can take over the boat only after all necessary payments have been made.

# Price Rectification: If any obvious mistakes are made in the price calculation, our company and the client will rectify the price in accordance with the existing price list without affecting the contract's validity.

# Payment Delays: Failure to make scheduled payments by the due date gives our company the right to cancel the charter and retain all deposits and fees paid to date.

YACHT TAKEOVER:

# Yacht Takeover: The Client takes over the yacht on Saturdays after 5:00 pm. Upon takeover, the Client inspects the boat and signs a checklist to confirm no damages, including the underwater part.

# Working Order: The conditional takeover confirms the yacht's working order, and all systems must be tested upon leaving the marina. Any defects should be reported immediately for repair.

# Complaints: Any complaints about the boat or equipment must be submitted in writing upon taking over the yacht.

# Liability: Our company is not liable for complaints or price reductions due to hidden defects or post-boarding damages beyond our control.

# Document Care: The client must take special care of all valid boat documents received during check-in.

YACHT RETURN:

# Boat Return: The boat must be returned by Friday at 6:00 pm (unless agreed otherwise in writing), in working order, fully equipped, and with a full tank.

# Condition and Obligations: The client must return the boat in good condition, clean (take out rubbish and wash dishes), and compile a written list of any defects or missing/lost objects. All boat documents must be returned to the base office.

# Charter Extension: Extending the charter period requires our company's consent.

# Late Return Charges: If the boat is not returned at the agreed time and location, the client agrees to pay 200% of the daily rate for each started date overdue.

# Late Return Justification: Late return due to force majeure must be promptly informed to our company. Unfavorable weather conditions cannot justify delays in returning the boat to the base marina.

OBLIGATIONS OF CHARTER COMPANY:

# Boat Provision: Our company will provide the yacht to the Client in full commission, proper working order, and with all required equipment, as stated on the website and official inventory list. The boat should be in impeccable condition, with filled diesel tanks, and delivered on the agreed time with necessary documentation.

# Damages and Claims: In case of any damage due to natural causes, the Client must contact our company immediately. We will rectify the damage within 24 hours, and no reimbursement will be provided to the Client.

# Liability and Force Majeure: Our company shall not be liable for any injuries, damages, or death resulting from the Client's use of the yacht or for delays caused by force majeure or rough weather conditions.

# Responsibility: Our company is not responsible for any travel and accommodation expenses, compensation for pain, loss of income, or any changes to the Client's plans due to bad weather or similar reasons during the charter period.

SECURITY DEPOSIT:

# Security Deposit: The Client must leave a security deposit (as per the price list) upon arrival at our Charter Base. The deposit can be paid in cash or by credit card and will be reimbursed after the boat is satisfactorily inspected upon return.

# Deposit Reimbursement: The full deposit will be reimbursed if there is no damage to the boat, its equipment, or third parties.

# Damages or Missing Equipment: If any damage or missing equipment is reported by the Client or discovered upon inspection by our company, part or all of the deposit will be retained to cover the cost of repairs or replacement.

# Fuel Charge: If the boat is returned with less fuel than during check-in, the charge for missing fuel will be deducted from the deposit as per the price list of lost equipment.

STANDARD & FLEXIBLE BOOKING CANCELLATION:

# Standard: If you cancel your charter at least 30 days prior to the start date, we retain 50% of the charter fee. In the event of a cancellation within 29 days of the charter, we retain 100% of the charter cost.

# Flexible: Up to 60 days prior to the charter, we will impose a 15% cancellation fee, or a minimum charge of 350 EUR. If you cancel 59 to 30 days prior to your charter, we retain 50% of the rental fee; if you cancel within 30 days of your charter, we retain 100% of the rental fee.

STANDARD & FLEXIBLE BOOKING RE-BOOKING:

# Standard: The customer may either change the rental duration to the same boat in season 2023 or change it to a different yacht in season 2023 up to 90 days after the rental date. The 150 EUR cost is due in both situations. There will be no reimbursements given if the price of the rebooked yacht or week is higher than the original price.

# Flexible: The customer may either alter the rental duration to the same boat in season 2023 or change it to a different yacht in season 2023 up to 60 days after the rental date. No refunds will be given if the price of the rebooked yacht or week is less than the price of the original reservation.

CLIENT’S OBLIGATIONS:

# Skipper Competence: The Client acting as skipper must have a valid open sea sailing license and GMDSS Radio Operator's license in ORIGINAL. They must sail only in Croatian territorial waters, unless otherwise agreed in writing.

# Safety and Conditions: The Client must not sail in wind force over seven (7) on the Beaufort Scale (30 knots) or when the vessel has un-repaired vital parts or insufficient fuel. They must ensure their nautical knowledge and competence and adhere to navigation rules and safety orders.

# Accidents and Damage: In case of accidents or damage, the Client must inform our company immediately and provide a written report. They must comply with our instructions and take actions to prevent further damage.

# Crew Responsibility: The Client is responsible for the crew, not exceeding the specified number. Alcohol/drug use, subleasing the yacht, participation in regattas, and night sailing are strictly prohibited.

# Equipment Care: The Client must check the motor's oil level daily, avoid unnecessary strain on masts/sails, and repair damages caused by their negligence at their expense.

# Insurance Coverage: Insurance does not cover damages due to lack of oil, intentional/negligent boat maneuvering, or damage to sails/motor.
